Terms of Service

1. Acceptance of Terms

By accessing or using the Studiorum application and related services, including our iOS applications (collectively, the "Service"), operated by BYTSized LLC, an Ohio limited liability company ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and BYTSized LLC.

2. Eligibility and Account Registration

Teacher / Creator Accounts: The teacher-facing features of the Service—including content creation, test building, grading, and administrative tasks—are available only to users who are 18 years of age or older. By registering a Teacher account, you represent and warrant that you are at least 18 years old and are legally authorized to create and manage content on behalf of yourself or your institution.

Student / Learner Accounts: The student-facing features—including taking assessments and AI tutoring—are available to users 13 years of age or older. We do not permit use of the Service by anyone under 13. Students may register directly, or a teacher or school administrator may create an account on the student's behalf. If a teacher or administrator creates a student account, they represent and warrant that they have appropriate authorization (such as parental consent or institutional authority) to do so.

Account Accuracy: You must provide accurate, complete, and current information when registering. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@studiorum.io if you suspect unauthorized use of your account.

3. User Roles

The Service operates with distinct user roles:

  • Teacher: Creates tests, generates AI-powered content, manages student access, and reviews grades.
  • Student: Takes assessments, engages with AI tutoring, and receives feedback.
  • School Administrator: Manages school licenses, bulk user creation, and institution-level settings.
  • Platform Administrator: BYTSized LLC personnel with system-wide access for operations and support.

4. Acceptable Use

You agree not to use the Service to:

  • Upload or transmit content that is unlawful, harmful, harassing, defamatory, or otherwise objectionable;
  • Attempt to gain unauthorized access to the Service or any related systems;
  • Use automated scripts, bots, or scraping tools to access or collect data from the Service;
  • Misrepresent your identity, role, or institutional affiliation;
  • Share your account credentials with others;
  • Generate content designed to mislead, harm, or produce academically dishonest results for students;
  • Circumvent any access controls, usage limits, or usage-metering systems;
  • Use the Service in any manner that could overburden or impair its infrastructure.

5. User Content

"User Content" means any material you submit, upload, or create through the Service, including questions, tests, rubrics, student submissions, and documents. You retain ownership of your User Content.

Student submissions: Student submissions are treated as educational records where applicable under FERPA (see Section 13). We do not claim ownership of student submissions, and we process them only to provide the Service.

Instructional content (teacher-authored): For instructional content you author — questions, activities, rubrics, and generated documents ("Instructional Content") — you grant BYTSized LLC a perpetual, irrevocable, worldwide, royalty-free license to store, process, display, adapt, and distribute that content as part of the Service. In plain language: if you delete your account, the questions and activities you created stay on Studiorum in anonymized form — permanently disconnected from your name and email — and may be made available to other educators, including through a searchable community activity bank. Your ownership of your own copies is unaffected.

You represent and warrant that: (a) you own or have the necessary rights to your User Content; (b) your User Content does not infringe any third-party intellectual property rights; and (c) your User Content complies with these Terms and all applicable laws.

6. Artificial Intelligence and Generated Content

The Service incorporates third-party artificial intelligence ("AI") services from Google (Gemini) and Anthropic (Claude). Gemini powers teacher activities — content generation, question and rubric creation, document and video processing, text-to-speech, image analysis and generation, writing-process analysis, and teacher-initiated automated grading of submitted work. Claude powers student activities — interactive tutoring (Magis), conversation practice, roleplay and chatbot activities, and student feedback flows.

AI Content Disclaimer: AI-generated content may contain errors, inaccuracies, or hallucinations. Teachers are responsible for reviewing and verifying all AI-generated content before using it in an educational setting. BYTSized LLC is not responsible for errors or omissions in AI-generated content.

Authenticity Signals Are Advisory: The Service can analyze the writing process behind a student's typed answer and produce an authenticity signal (for example, an indication that text was pasted rather than typed). These signals are advisory tools intended to inform a conversation between teacher and student. By using them, you agree not to treat any AI-produced score or signal as sole or conclusive proof of academic misconduct or as the sole basis for a disciplinary decision.

No Professional Advice: AI responses from the Service do not constitute professional, medical, legal, financial, or psychological advice. Tutoring responses are for educational assistance only.

7. Test Monitoring and Lockdown Browsers

Teachers may enable test-security features for individual tests, including tab-switch and fullscreen monitoring, copy/paste blocking, live monitoring, and lockdown-browser requirements. If you enable these features, you are responsible for complying with your school's or district's policies and applicable law, and for informing students that monitoring is in effect before they begin a monitored test. The data recorded by these features is described in our Privacy Policy.

Lockdown-secured testing relies on third-party software: Safe Exam Browser (an open-source project) and/or the Studiorum Secure Testing browser extension for managed Chromebooks. This software is provided "as is," and its behavior on a given device depends on the device's configuration. While these features meaningfully raise the difficulty of misconduct, BYTSized LLC does not guarantee that any monitoring or lockdown feature will detect or prevent all academic misconduct.

8. LMS Integrations (LTI)

The Service supports LTI 1.3 integration with learning management systems. By connecting an LMS, the institution authorizes the exchange of data between the LMS and the Service, including single sign-on identity, course roster information, assignment placements, and grade passback to the LMS gradebook. Grades and records held in the institution's LMS are controlled by the institution and governed by its own policies. LMS administrators are responsible for the accuracy of their platform configuration and for authorizing which courses and users may use the integration.

9. Sharing Content with Other Teachers

The Service lets teachers share questions and tests with other teachers. By sharing content, you grant the recipient a license to use, duplicate, and modify their copy of that content for their own teaching. Shared questions are duplicated into the recipient's account; shared tests may be duplicated or, if you choose co-teaching, worked on collaboratively with the roles you assign. Revoking a collaborator's access does not recall copies that were already duplicated into another teacher's account. Do not share content you lack the rights to share.

10. Intellectual Property

The Service, including its software, design, features, and original content created by BYTSized LLC (excluding User Content), is the exclusive property of BYTSized LLC and its licensors, protected by copyright, trademark, and other applicable laws. Nothing in these Terms grants you a right to use any trademark or intellectual property of BYTSized LLC except as expressly provided herein.

AI-generated outputs produced through the Service are provided to you for your use subject to these Terms. You should consult applicable law regarding the copyright status of AI-generated content, as this area of law continues to evolve.

Third-Party Trademarks: AP®, Advanced Placement®, and SAT® are trademarks registered by the College Board, which is not affiliated with, and does not endorse, this product or the Service. ACT® is a registered trademark of ACT, Inc., which is not affiliated with, and does not endorse, this product or the Service. Safe Exam Browser is an open-source project of ETH Zürich. Kahoot!, Quizlet, Blooket, Quizizz, Gimkit, Anki, Brainscape, Canvas, Moodle, Blackboard, and Schoology are trademarks of their respective owners; none of these organizations is affiliated with, or endorses, this product or the Service. Export formats are provided for interoperability only. All other third-party names, marks, and logos are the property of their respective owners and are used for identification purposes only.

11. Subscriptions, Payments, and Usage Allowances

Subscriptions: Certain features require an active subscription billed on a monthly recurring basis. By subscribing, you authorize BYTSized LLC to charge your payment method each billing cycle until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.

Usage Allowances: AI features (content generation, grading, tutoring, and similar) draw on a weekly usage allowance that resets automatically every seven days. Different actions draw on the allowance at different rates, reflected in the usage meter shown in the Service. Every account has a base allowance; paid subscription tiers provide a larger weekly allowance for as long as the subscription is active. Allowances have no cash value, are not transferable, and unused weekly allowance does not carry over.

Extra Usage Purchases: Additional usage may be purchased in one-time packs ("Extra Usage"). Extra Usage is consumed automatically after your weekly allowance runs out and does not expire for as long as your account remains open. All Extra Usage purchases are final and non-refundable once credited to your account. Extra Usage has no cash value and is not transferable.

Refunds: Subscription fees are non-refundable except as required by applicable law or at our sole discretion.

Payment Processing: All payments are processed by Stripe, Inc. We do not store your payment card details. Your use of Stripe is governed by Stripe's terms and privacy policy.

Pricing Changes: We reserve the right to change subscription or Extra Usage pricing. We will provide at least 30 days' notice of material pricing changes to active subscribers.

12. School and Institution Licensing

Schools and districts that obtain institutional licenses ("School Licenses") are subject to a separate School Licensing Agreement, which may include a Data Processing Agreement ("DPA"). Individual users within a school license are also bound by these Terms. In the event of a conflict between these Terms and a School Licensing Agreement, the School Licensing Agreement shall govern with respect to that institution's use. 13. FERPA Compliance and Student Data

To the extent the Service is used in connection with an educational institution and involves student education records, BYTSized LLC acts as a "school official" with a legitimate educational interest as defined under the Family Educational Rights and Privacy Act ("FERPA"), 20 U.S.C. § 1232g. We use Student Data only to provide and improve the Service and do not sell or disclose student education records to third parties except as necessary to operate the Service or as permitted by applicable law.

Teachers and school administrators are responsible for ensuring that their use of the Service complies with FERPA and any applicable state student privacy laws. Students (or their parents/guardians if the student is under 18) may request access to, correction of, or deletion of their education records by contacting support@studiorum.io.

14. Termination

We may suspend or terminate your account immediately, with or without notice, for any breach of these Terms or for any other reason at our sole discretion. Upon termination or account deletion:

  • Your right to use the Service ceases immediately.
  • Your personal information and account data are permanently deleted from active systems, as described in Section 9 of our Privacy Policy.
  • Instructional Content you authored is retained in anonymized, de-identified form under the license in Section 5, and student submissions on other teachers' tests remain part of those teachers' gradebooks.
  • Any remaining weekly allowance and unused Extra Usage balances are forfeited without refund.

You may delete your account at any time through the Service (Account Settings → Account). The Privacy Policy describes in detail what is deleted and what is retained.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE FOR ANY PARTICULAR EDUCATIONAL PURPOSE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BYTSIZED LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY AI-GENERATED CONTENT; (C) UNAUTHORIZED ACCESS TO YOUR DATA; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100).

17. Indemnification

You agree to indemnify and hold harmless BYTSized LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right.

18. Dispute Resolution and Arbitration

Informal Resolution: Before filing any formal legal claim, you agree to contact us at support@studiorum.io to attempt informal resolution. We will make reasonable efforts to resolve the dispute within 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Either party may bring an eligible claim in small claims court in lieu of arbitration.

Class Action Waiver: Any arbitration or legal proceeding shall be conducted on an individual basis only. You waive the right to participate in any class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

19. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Ohio.

20. Changes to These Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' advance notice by email or through the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

21. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and any applicable School Licensing Agreement, constitute the entire agreement between you and BYTSized LLC regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
  • Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
